The legal situation
The EU has clarified that CBD is not a narcotic when lawfully produced, and CosIng (the EU ingredient database) lists Cannabidiol with cosmetic functions such as antioxidant and skin-conditioning. The decisive factor is the source and preparation.
The three requirements on the CBD source
- Permitted: CBD from industrial hemp (Cannabis sativa) or synthetically produced CBD.
- Prohibited: CBD prepared as an extract, tincture or resin of cannabis — that falls under Annex II, entry 306.
- Documentation: a written source statement from the manufacturer should substantiate this.
The THC limit — stricter in Sweden
Many believe the EU''s 0.2% THC limit applies. For cosmetics in Sweden the line is stricter: non-detectable THC. Any trace can classify the product as a narcotic. Therefore require a batch-specific certificate of analysis (CoA) with a stated limit of detection (LOQ).
What is required to (re)sell a CBD cosmetic?
- CPNP notification + a named responsible person within the EU.
- PIF (product information file) and CPSR (safety report).
- Full INCI and correct labelling in the market''s language.
- GMP (ISO 22716) at the manufacturer.
